Michael Gilbert, a 29-year-old Flanders man, was found guilty of second-degree murder this week in the fatal 2021 shooting of Tyrell Durham.
Gilbert shot Durham in Moriches, said Suffolk County District Attorney Ray Tierney, following an argument that Durham had with Gilbert’s girlfriend at a Moriches housing complex.
“A man is dead because a needless argument caused this defendant to pull a trigger and thoughtlessly take the victim’s life,” Tierney said.
The shooting at apartments at Tall Oaks Circle occurred after Gilbert overheard Durham, who was 37, yelling obscenities at Gilbert’s girlfriend, Lashonda Coles, on the telephone. Coles and Durham both lived in the housing complex.
The argument escalated and eventually Gilbert challenged Durham to “meet me outside.”
Durham obliged, and Gilbert then fired six shots from a .22 semiautomatic handgun, hitting Durham three times.
Gilbert is facing up to 40 years in prison following a jury trial at the Arthur M. Cromarty Court Complex in Riverside.
Along with the felony murder conviction, he was also found guilty of criminal possession of a weapon in the second degree, a felony. He will be sentenced on November 2.
